This Agreement governs your use of the Smobilpay Service. By using the Smobilpay Service, you agree to this Agreement, the Privacy Policy, and any updates posted from time to time. If you do not agree, please do not use the Smobilpay Service.<\/p><p data-start=\"671\" data-end=\"1157\">\u00a0<\/p><h3 data-start=\"1159\" data-end=\"1533\"><strong data-start=\"1159\" data-end=\"1198\">2. Description of Smobilpay Service<\/strong><\/h3><p class=\"\" data-start=\"1159\" data-end=\"1533\">Maviance provides payment and financial services via the Smobilpay platforms, including multiple web portals, mobile apps, APIs, and integrations to users and partners in Cameroon and the CEMAC region. These services are designed to facilitate bill payments, money transfers, merchant interactions, and digital financial management.<\/p><p data-start=\"1159\" data-end=\"1533\">\u00a0<\/p><h3 data-start=\"1535\" data-end=\"2150\"><strong data-start=\"1535\" data-end=\"1584\">3. Account Creation and User Responsibilities<\/strong><\/h3><p class=\"\" data-start=\"1535\" data-end=\"2150\">Users must be at least 18 years old or have parental\/guardian consent and the legal capacity to enter into contracts. Users are subject to a Know Your Customer (KYC) process requiring accurate and up-to-date information. Maviance may suspend or terminate accounts that violate the compliance framework or engage in fraudulent activity. Users are responsible for maintaining the security of their login credentials and all actions taken under their account. You must also comply with any applicable technical integration protocols and Maviance\u2019s security policies.<\/p><p data-start=\"1535\" data-end=\"2150\">\u00a0<\/p><h3 data-start=\"2152\" data-end=\"2256\"><strong data-start=\"2152\" data-end=\"2180\">4. Acceptable Use Policy<\/strong><\/h3><p class=\"\" data-start=\"2152\" data-end=\"2256\">The service must be used lawfully and ethically. Prohibited uses include:<\/p><ul data-start=\"2257\" data-end=\"2622\"><li class=\"\" data-start=\"2257\" data-end=\"2323\"><p class=\"\" data-start=\"2259\" data-end=\"2323\">Fraudulent, unauthorized, misleading, or unlawful transactions<\/p><\/li><li class=\"\" data-start=\"2324\" data-end=\"2384\"><p class=\"\" data-start=\"2326\" data-end=\"2384\">Submission of false, inaccurate, or outdated information<\/p><\/li><li class=\"\" data-start=\"2385\" data-end=\"2434\"><p class=\"\" data-start=\"2387\" data-end=\"2434\">Harassment, stalking, or abuse of other users<\/p><\/li><li class=\"\" data-start=\"2435\" data-end=\"2494\"><p class=\"\" data-start=\"2437\" data-end=\"2494\">Spamming or sharing offensive or discriminatory content<\/p><\/li><li class=\"\" data-start=\"2495\" data-end=\"2561\"><p class=\"\" data-start=\"2497\" data-end=\"2561\">Disrupting service integrity or attempting unauthorized access<\/p><\/li><li class=\"\" data-start=\"2562\" data-end=\"2622\"><p class=\"\" data-start=\"2564\" data-end=\"2622\">Hosting harmful software or generating excessive traffic<\/p><\/li><\/ul><p class=\"\" data-start=\"2624\" data-end=\"2722\">Maviance reserves the right to suspend or terminate services at its sole discretion in such cases.<\/p><p data-start=\"2624\" data-end=\"2722\">\u00a0<\/p><h3 data-start=\"2724\" data-end=\"3006\"><strong data-start=\"2724\" data-end=\"2752\">5. You may not:<\/p><ul data-start=\"3007\" data-end=\"3188\"><li class=\"\" data-start=\"3007\" data-end=\"3056\"><p class=\"\" data-start=\"3009\" data-end=\"3056\">Copy, reverse engineer, or modify the service<\/p><\/li><li class=\"\" data-start=\"3057\" data-end=\"3135\"><p class=\"\" data-start=\"3059\" data-end=\"3135\">Create derivative works or use the content commercially without permission<\/p><\/li><li class=\"\" data-start=\"3136\" data-end=\"3188\"><p class=\"\" data-start=\"3138\" data-end=\"3188\">Transfer or sublicense the Intellectual Property<\/p><\/li><\/ul><p class=\"\" data-start=\"3190\" data-end=\"3317\">You agree that you do not acquire any right, title, or interest in or to Maviance\u2019s Intellectual Property by using the service.<\/p><p data-start=\"3190\" data-end=\"3317\">\u00a0<\/p><h3 data-start=\"3319\" data-end=\"3682\"><strong data-start=\"3319\" data-end=\"3341\">6. Confidentiality<\/strong><\/h3><p class=\"\" data-start=\"3319\" data-end=\"3682\">All information disclosed by either party that is marked as confidential, or understood to be confidential, must remain confidential and not be disclosed to third parties without prior written consent. This includes technical data, trade secrets, and business plans. This obligation continues even after the termination of this Agreement.<\/p><p data-start=\"3319\" data-end=\"3682\">\u00a0<\/p><h3 data-start=\"3684\" data-end=\"3977\"><strong data-start=\"3684\" data-end=\"3721\">7. Third-Party Sites and Services<\/strong><\/h3><p class=\"\" data-start=\"3684\" data-end=\"3977\">This Agreement does not apply to third-party websites or services linked through the Smobilpay Service. Maviance is not responsible for the content, data practices, or activities of those third-party sites. Users follow external links at their own risk.<\/p><p data-start=\"3684\" data-end=\"3977\">\u00a0<\/p><h3 data-start=\"3979\" data-end=\"4466\"><strong data-start=\"3979\" data-end=\"4006\">8. Term and Termination<\/strong><\/h3><p class=\"\" data-start=\"3979\" data-end=\"4466\">This Agreement is valid for two (2) years from the signature date and will auto-renew annually unless either party provides three (3) months\u2019 written notice. Users may terminate the Agreement at any time with thirty (30) days\u2019 notice. Maviance may terminate immediately for non-compliance or breach. Upon termination, Maviance may return any user data upon request within 30 days. After that, all data will be deleted unless legally required to be retained.<\/p><p data-start=\"3979\" data-end=\"4466\">\u00a0<\/p><h3 data-start=\"4468\" data-end=\"4764\"><strong data-start=\"4468\" data-end=\"4486\">10. This Agreement governs your use of the Smobilpay Service. By using the Smobilpay Service, you agree to this Agreement, the Privacy Policy, and any updates posted from time to time. Description of Smobilpay Service Maviance provides payment and financial services via the Smobilpay platforms, including multiple web portals, mobile apps, APIs, and integrations to users and partners in Cameroon and the CEMAC region. These services are designed to facilitate bill payments, money transfers, merchant interactions, and digital financial management. \u00a0 3. Account Creation and User Responsibilities Users must be at least 18 years old or have parental\/guardian consent and the legal capacity to enter into contracts. Users are subject to a Know Your Customer (KYC) process requiring accurate and up-to-date information. Maviance may suspend or terminate accounts that violate the compliance framework or engage in fraudulent activity. Users are responsible for maintaining the security of their login credentials and all actions taken under their account. You must also comply with any applicable technical integration protocols and Maviance\u2019s security policies. \u00a0 4. Acceptable Use Policy The service must be used lawfully and ethically. Prohibited uses include: Fraudulent, unauthorized, misleading, or unlawful transactions Submission of false, inaccurate, or outdated information Harassment, stalking, or abuse of other users Spamming or sharing offensive or discriminatory content Disrupting service integrity or attempting unauthorized access Hosting harmful software or generating excessive traffic Maviance reserves the right to suspend or terminate services at its sole discretion in such cases. \u00a0 5. Intellectual Property All rights, title, and interest in the Smobilpay Services, including but not limited to patents, trademarks, designs, copyrights, software code, algorithms, and trade secrets (&#8220;Intellectual Property&#8221;) remain the sole property of Maviance. You may not: Copy, reverse engineer, or modify the service Create derivative works or use the content commercially without permission Transfer or sublicense the Intellectual Property You agree that you do not acquire any right, title, or interest in or to Maviance\u2019s Intellectual Property by using the service. \u00a0 6. Confidentiality All information disclosed by either party that is marked as confidential, or understood to be confidential, must remain confidential and not be disclosed to third parties without prior written consent. This includes technical data, trade secrets, and business plans. This obligation continues even after the termination of this Agreement. \u00a0 7. Third-Party Sites and Services This Agreement does not apply to third-party websites or services linked through the Smobilpay Service. Maviance is not responsible for the content, data practices, or activities of those third-party sites. Users follow external links at their own risk. \u00a0 8. Term and Termination This Agreement is valid for two (2) years from the signature date and will auto-renew annually unless either party provides three (3) months\u2019 written notice. Users may terminate the Agreement at any time with thirty (30) days\u2019 notice. Maviance may terminate immediately for non-compliance or breach. Upon termination, Maviance may return any user data upon request within 30 days. After that, all data will be deleted unless legally required to be retained. \u00a0 10. Disclaimer While Maviance strives to provide accurate and updated information, the Smobilpay Service is offered \u201cas is.\u201d We do not guarantee uninterrupted access, system compatibility, or the completeness of content. Users are responsible for verifying any content before relying on it. \u00a0 11. Indemnity You agree to indemnify and hold Maviance harmless from any claims, damages, liabilities, or legal actions resulting from your misuse of the Smobilpay Service, violation of third-party rights, or breach of these Terms. \u00a0 12.
